Terminated Member Reinstated

Union member James Webb was terminated when his employer alleged that he stole a wallet from a nurse employed by Hahnemann University Hospital. After failing to settle the resulting grievance, the Union filed for arbitration on behalf of Mr. Webb.

The Arbitrator found that Mr. Webb's Employer failed to meet the burden of showing just cause because:

As a result of the arbitration award, James Webb was reinstated "at another of (the Employer's) clients in the Philadelphia area." Further, the Arbitrator directed the Employer to pay Mr. Webb lost wages. The Arbitrator has retained jurisdiction to address any issues resulting from the remedy's implementation.
